I am Jan Trzaskowski, law professor with a focus on marketing, technology, privacy and psychology, and author of Your Privacy Is Important to Us! – Restoring Human Dignity in Data-Driven Marketing [as well as many other books, chapters and articles]. This website is dedicated to my research on how fundamental rights can serve as guiding principles in business and tech law & policy.

Social media have been a decade-long dress rehearsal in online manipulation. AI can create information, make predictions and take decisions that will affect human behaviour, including our behaviours as citizens, workers and consumers. Safeguards are needed, since generative AI will only exacerbate the personal, social and societal harms already caused by data-driven business models.

My research examine the centrality of human dignity in tech law and policy and how our mindsets and legal frameworks must be informed by psychological, technological and societal perspectives. Based on insights from market dynamics, marketing techniques, design strategies, and human frailties I have demonstrated how information asymmetries have reduced individual agency and the ability to create transparency.

Human dignity is a core value in liberal democracies that must also be reflected in tech policy. Protections are required when businesses interfere with our rights to freedom, privacy, non-discrimination and property. With the digitalisation of the human experience, users have become programmable objects. We cannot rely on regulation alone and need to discuss how we can act to reclaim our dignity.

Businesses – like consumers – are vulnerable in digital markets that lack competition, transparency and user empowerment.

Your Privacy Is Important to Us! – Restoring Human Dignity in Data-Driven Marketing

Your Privacy Is Important to Us! explores the application of EU consumer law—including data protection law and other fundamental rights—to data-driven business models that infringe on human agency, social cohesion and democratic debate. It suggests how our current legal framework can be informed by psychological, technological and societal perspectives to curb predatory business models of surveillance capitalism.

The book elucidates the potential for cross-fertilisation between data protection law and marketing law, and it demonstrates how the protection of human dignity, privacy and non-discrimination may corroborate these legal disciplines.

It is argued that ‘paying with personal data’ is a misleading framing when, in fact, we pay with attention and agency—which are both scarcer and more precious than personal data and are also important in social and societal contexts. A three-tiered model of information asymmetry is introduced to illustrate why information does not ensure transparency, which is a prerequisite for user empowerment.

The aim is to inform and amplify ongoing debates by providing a coherent framing of data-driven marketing in the context of law, psychology, technology and society.

About the author

Jan Trzaskowski, PhD, is Law Professor at Aalborg University and author of the important and successful book Your Privacy Is Important to Us! – Restoring Human Dignity in Data-Driven Marketing [as well as many other books, chapters and articles].

Since the mid-1990s, he has dealt with legal and regulatory aspects of information technology, and his research focuses on the protection of consumers and fundamental rights, including privacy. He has a keen interest in human decision-making (psychology and marketing) and the role of persuasive technology. Currently, he focuses on the regulation of AI and data-driven business models, including the role of human dignity (freedom, privacy and non-discrimination) and fundamental rights impact assessments.

He was Head of the Danish delegation negotiating the 2000 E-Commerce Directive, and in his early teens, he wrote Commodore 64 assembly language routines that were published in Danish computer magazine IC RUN.
